More Charges Filed Against James Bentley

The brother of a man who was charged in connection with the death of a 10-year-old Cedar Rapids girl sits in jail and faces additional charges Monday in connection with abusing the same girl.

Roger Bentley 37, was charged Monday with first-degree murder and kidnapping in connection with Jetseta Gage's death last week.

His brother is James Bentley, of Vinton. James Bentley was jailed before Gage's death and is accused of sexually abusing Gage over a nearly three-year span in two counties.

The criminal case began late last year in Gage's hometown of Cedar Rapids in Linn County. Cedar Rapids police accuse James Bentley of first abusing Gage when she was 7, from Jan. 1, 2002, until Nov. 17, 2004.

Vinton Police Chief Jeff Tilson said based on information investigators uncovered in the Cedar Rapids police case, he and the Benton County attorney filed another sexual abuse charge against James Bentley. That charge accuses him of abusing the girl in Vinton in October and November of last year.

A criminal complaint said on two days last October and two days in November, James Bentley ''had a 10-year-old girl stay overnight at his apartment ... in Vinton. During the dates of the overnight visits, the Defendant did perform a sex act with the 10-year-old girl while she was staying at his apartment.''

Is it just coincidence that Roger Bentley is accused of murdering the key witness in his brother's sexual abuse cases? Police and prosecutors say they don't know.

"Our officers have been investigating her death and we're only beginning to learn about his brother's case. One, we don't have any information and two, I just wouldn't want to speculate on that," said J. Patrick White, attorney for Johnson County.

A Des Moines defense attorney said there's no doubt that Gage's murder will affect the two sexual abuse cases against James Bentley.

"The defense lawyers are obligated to raise that issue. So you're going to have, potentially, a fight that a judge is going to have to resolve, in terms of where this case is going to go," said Bob Rigg, of the Drake Legal Clinic.
